Introduction

Unless otherwise stated, the term “Site” refers to the current website of Patrick Morin Inc. (“Patrick Morin”). In these Terms of Use (the “Terms”), users of the Site are referred to as “you.” Patrick Morin is referred to as “Patrick Morin,” “we,” “us” and “our.” Your use of the Site is subject to these Terms and our Privacy Commitment. By using the Site, you confirm that you agree to comply with these Terms and that you consent to the contents of the Privacy Commitment, which may be amended by Patrick Morin from time to time without notice. Any transaction attempted or completed through the Site is also subject to the applicable laws and to the terms of sale described in the FAQ.

Creating an account

Security and Privacy Conditions

It is not necessary to create an account to proceed with a transaction on the Site. If you create an account, the personal information collected will be managed according to our Privacy Commitment.

You are responsible for transactions made through your account. When you make an online purchase, your payment information may be retained by our payment service provider.

Account Suspension and Deletion

Patrick Morin reserves the right to suspend or delete your account for any serious reason, including prolonged inactivity or fraudulent or suspicious activities related to this account. You may request to have your account deactivated at any time.

When you log in using Google or Facebook Single Sign-On (SSO), we collect and process the following information:

  • Basic Profile Information: Name, email address, profile picture (if available).
  • Authentication Data: OAuth tokens used for secure login.
  • Additional Data (if permissions are granted): Other details authorized by you during login.

  • Authenticate you and log you into your account.
  • Enhance the user experience and provide personalized services.
  • Ensure account security and prevent unauthorized access.

Data Sharing and Third-Party Services

We do not sell or share your personal data with third parties for marketing purposes.

Your login credentials remain with Google and Facebook—we do not store or manage passwords.

Intellectual property

The Site and its contents, including graphics, images, texts and audiovisual elements, as well as the source code and software or plug-ins incorporated therein (the “Content”), are protected by copyright and/or trademark laws and/or other intellectual property laws. Patrick Morin is the owner of the rights to the Content and the Site and of the licences granting it the right to use and distribute the Content and the Site. All intellectual property rights in the Content and the Site are reserved by Patrick Morin or their respective owners. Any reproduction, publication, creation of derivative works, or any other use of the Content or the Site without the consent of the owner of the intellectual property rights is prohibited.

Provided you comply with these Terms, Patrick Morin authorizes you to view, download and print a single copy of the Content and the Site solely for your personal, non-commercial use, unless you are a business customer. The use of the Content on any website other than the Site is prohibited.

Without limiting the generality of the foregoing, the use of framing or similar features is prohibited, as is any downloading or systematic querying of the Site for purposes other than indexing for a public search engine or in violation of the instructions contained in a robot.txt file. The use of the Content of the Site by a price aggregator is expressly prohibited.

Limitation of liability

Your use of the Site is at your own risk. Despite our efforts to avoid them, errors or inaccuracies may appear in the Content of the Site (particularly in product descriptions and photographs). Patrick Morin will not be liable for any damages arising from such errors. If you see something that you believe to be incorrect or inaccurate, please let us know as soon as possible.

Furthermore:

  • We reserve the right to change any information on the Site (including product and service descriptions and prices) without notice.
  • Products or services advertised may not be available at the time of order or thereafter.
  • We may limit the number of products that can be purchased in any single transaction or series of transactions.
  • We reserve the right to cancel an order or not proceed with it (even if it has been accepted) if the price or any important information relating to it is incorrect. In such an event, we will notify you of the situation and credit you for the amount of the order if it has been paid for.

We provide the Site to you “as is.” We make no representations or warranties as to the accuracy of the Content or its operation. Although security measures are in place to protect the Site and our information systems, absolute security does not exist, and we cannot guarantee that the Site or the server that makes it available are or will be free of viruses or other harmful components.

You agree not to hold us responsible for the content of any hyperlink to which the Site may lead. More generally, you agree not to hold us liable for any damages arising from your use of the Site.

WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, PATRICK MORIN WILL NOT BE LIABLE IN CONTRACT, TORT OR OTHERWISE FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF ANTICIPATED PROFITS OR REVENUE OR OTHER ECONOMIC LOSS ARISING OUT OF ANY ACT OR OMISSION OF PATRICK MORIN, ITS AGENTS OR AFFILIATES.

Modification or suspension of the Site

At its sole discretion and at any time, Patrick Morin may modify, interrupt or suspend the operation of the Site, any part of it or the Content, temporarily or permanently, without notice or liability to you.

Governing law

Any dispute arising from the use of the Site will be governed by the laws of Quebec and will be brought before a court in the judicial district of Joliette.

Changes to these Terms

Patrick Morin may modify the content of these Terms at its discretion. If these Terms are amended, you will be notified of the changes by a notice posted on the home page of our Site for a specified period of time. Your continued use of the Site will mean that you accept the changes.

 

Mobile Conditions

Patrick Morin's mobile messaging service (the “Service”) is operated by Patrick Morin (“Patrick Morin”, “we”, “us” or “our”). Your use of the Service constitutes your acceptance of these terms and conditions (“Mobile Terms”). We may change or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also change these Mobile Terms at any time and your continued use of the Service after the effective date of such changes will constitute your acceptance of such changes.

By accepting Patrick Morin's SMS messaging service, you agree to receive recurring SMS messages from and on behalf of Patrick Morin through your wireless carrier to the cell phone number you have provided, even if your cell phone number is on a state or federal do not call list. Text messages can be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, special offers and other marketing offers (for example, shopping cart reminders).

You understand that you are not required to register for this program in order to make purchases and that your consent is not a condition of purchasing from Patrick Morin. Your participation in this program is entirely voluntary.

We do not charge for the service, but you are responsible for all fees and charges associated with text messaging imposed by your wireless carrier. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless service provider for details. You are solely responsible for all SMS-related charges, including those imposed by your wireless service provider.

You may withdraw from the service at any time. To do so, text the STOP command to 1-855-376-7008 or click on the unsubscribe link (if any) in any text message. You will receive a single SMS confirming your unsubscription. No further messages will be sent to your mobile device unless initiated by you.If you have subscribed to other Patrick Morin mobile messaging programs and wish to unsubscribe, unless otherwise required by applicable law, you will need to unsubscribe separately from those programs by following the instructions provided in their respective terms of use.

We may change the short codes or telephone numbers we use to operate the Service at any time, and we will notify you of any such changes. You acknowledge that messages, including STOP or HELP requests, that you send to a short number or telephone number that we have changed may not be received and that we will not be obliged to honour any requests made in such messages.

Mobile operators supported by the service are not responsible for delayed or undelivered messages. You agree to provide us with a valid cell phone number. If you obtain a new cell phone number, you will be required to register for the Program with your new number.

 To the extent permitted by applicable law, you agree that we will not be liable for the failure, delay or misdelivery of any information sent through the service, for any errors in such information and/or for any action you may or may not take in reliance on the information or the service.
